Terms of Use

Please read these Terms of Use ("Terms") carefully. They form a legally binding agreement between you and GreenRah OÜ. GreenRah gives you estimated, informational routing and heat/shade guidance, it is not a medical, safety, or emergency service, and you remain responsible for your own decisions outdoors.

These Terms govern access to and use of GreenRah, operated by GreenRah OÜ, a private limited company (osaühing) registered in Estonia ("GreenRah", "we", "us", "our"). By opening, browsing, or otherwise using GreenRah, with or without an account, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use GreenRah.

If you create an account, you must additionally tick a checkbox confirming acceptance of these Terms and the Privacy Policy. That acceptance is a condition of registration and creates a binding record of your agreement in addition to your general use of the app.

If you are using GreenRah on behalf of an organization, you confirm you have the authority to bind that organization to these Terms.

You must be at least 16 years old, or the minimum age at which you can consent to data processing under the law of your country, to create a GreenRah account. By registering, you represent that you meet this requirement. GreenRah is a global web application; it is your responsibility to ensure your use of it complies with the laws that apply to you in your own location.

GreenRah provides estimated walking routes and thermal- or accessibility-related indicators, calculated using inputs such as weather, sun position, modeled shade, elevation, and map data. Features, coverage areas, and the cities we support may change, expand, or be discontinued over time, and we do not guarantee that any specific feature will remain available. Pre-release, beta, or password-protected environments may be unstable and are provided strictly "as is" for invited testing, with no guarantee of accuracy or continuity.

We continuously improve our underlying technology and reserve the right to modify how the service is built, hosted, or operated at our sole discretion, without disclosing implementation details that are proprietary or confidential to our business.

Routes, shade estimates, heat-stress indicators (including UTCI-style scores), accessibility suggestions, and any similar guidance are estimated indicators only, generated from third-party and modeled data that can be rarely incomplete, outdated, or inaccurate. They are not medical advice, a safety guarantee, or an emergency service. Do not use GreenRah as a substitute for professional medical guidance, official weather warnings, or emergency services. If you are in a medical or safety emergency, contact local emergency services immediately, do not rely on this app.

Outdoor conditions change quickly and can differ from what the app shows. Always apply your own judgment about your health, mobility, hydration, and the real conditions you observe around you.

You are solely responsible for your own safety, health decisions, and choices while outdoors, including whether and how to follow a route suggested by GreenRah. GreenRah OÜ is not liable for heat illness, injury, property damage, getting lost, or any other harm that results from following, misreading, or disregarding information in the app. Adjust to your own physical condition, local weather warnings, traffic, terrain, and any other real-world conditions we cannot detect. Do not rely on GreenRah alone during extreme heat, extreme cold, storms, or any other hazardous condition, and do not use it as your only source of information for medical or safety-critical decisions.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly at support [@] greenrah {.} com if you suspect unauthorized use. You agree to provide accurate account information and to keep it up to date. Opting in to the optional research contribution is separate from, and not required for, your acceptance of these Terms and the Privacy Policy; leaving it unticked never affects your ability to use the app.

We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, misused the service, created risk or legal exposure for GreenRah or other users, or if we are required to do so by law. You may also delete your account at any time from your account settings or by contacting us; see our Privacy Policy for what happens to your data on deletion.

You agree not to: misuse, disrupt, or attempt to disable the service; scrape, crawl, or extract data at a scale or frequency that burdens our infrastructure; reverse engineer, decompile, or attempt to derive our source code, models, or underlying methodology beyond what is expressly permitted by applicable law; probe, test, or bypass our security or access controls; impersonate another person or misrepresent your affiliation; upload or transmit unlawful, harmful, or infringing content; or use GreenRah to build a directly competing product using data obtained from the service. We may suspend or restrict access for anyone we reasonably believe is violating this section.

The GreenRah name, logo, branding, interface design, software, simulation formula for calculating Thermal Comfort Score and original content are owned by GreenRah OÜ or its licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use GreenRah for its intended purpose. This license does not include any right to copy, resell, sublicense, or create derivative works from our software, design, or proprietary data models. Map, weather, and geocoding data displayed in the app may be owned by third parties and remain subject to their own licenses.

If you submit feedback, suggestions, or ideas about GreenRah, you grant us a perpetual, worldwide, royalty-free license to use them to improve the service, without any obligation to compensate or credit you.

Map, weather, geocoding, and similar data displayed in GreenRah come from third-party providers. GreenRah OÜ does not control and is not liable for outages, delays, or inaccuracies in that third-party data, or for decisions you make based on it. GreenRah may contain links to third-party websites or services; we do not endorse and are not responsible for their content, accuracy, or practices, including their own privacy practices.

GreenRah is currently offered free of charge. We may introduce paid plans, subscriptions, or premium features in the future. If we do, we will describe the applicable pricing and terms clearly before you are asked to pay, and any such payment terms will supplement (not silently override) these Terms.

To the fullest extent permitted by applicable law, GreenRah is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant that the app will be available at all times, that data shown will be accurate or complete, or that any route will actually be cooler, shadier, safer, or more accessible in practice than an alternative. Nothing in these Terms excludes or limits any statutory guarantee or consumer right that cannot lawfully be excluded in your country of residence.

To the fullest extent permitted by applicable law, GreenRah OÜ, its founders, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, health, or other intangible losses, arising out of or related to your access to or use of, or inability to access or use, GreenRah, even if we have been advised of the possibility of such damages. Because GreenRah is currently offered free of charge, our total aggregate liability to you for any claim arising from these Terms or your use of the service is limited to the greater of (a) any amount you actually paid us in the twelve months before the claim arose, or (b) fifty euros (€30), except where such a limit is not permitted by mandatory law. Mandatory consumer-protection rights in your country of residence that cannot lawfully be waived or limited are not affected by this section.

You agree to defend, indemnify, and hold harmless GreenRah OÜ and its founders, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the service, or your violation of any law or the rights of a third party, to the extent permitted by applicable law.

Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. We do not sell your personal data to third parties. Location data is collected and used only as described there, consistent with the GDPR and applicable data protection law.

You may stop using GreenRah and delete your account at any time. We may suspend or terminate access to all or part of the service, for any user or generally, at our discretion, including to comply with law, protect the service or other users, or in response to a violation of these Terms. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including outages of third-party data or infrastructure providers, internet or power failures, natural disasters, extreme weather, war, or governmental action.

We may update these Terms as GreenRah evolves and expands to new cities and countries. We will update the "Last updated" date, and for material changes we will provide reasonable notice, such as an in-app notice or an email to account holders. Continued use of GreenRah after a change takes effect means you accept the revised Terms, to the extent permitted by law; where required, we will ask account holders for renewed acceptance.

These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules, and without prejudice to any mandatory consumer-protection provisions that apply in your country of residence within the EU/EEA and cannot be waived by agreement. If you are a consumer resident in the EU/EEA, you may bring proceedings in the courts of your own country of residence in addition to Estonia, where mandatory law grants you that right. We encourage you to contact us first at support [@] greenrah {.} com so we can try to resolve any concern informally before any formal process. EU residents may also use the European Commission's Online Dispute Resolution platform where applicable.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect and the unenforceable part will be interpreted to best reflect its original intent. Our failure to enforce a right under these Terms is not a waiver of that right. You may not assign or transfer your rights under these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between you and GreenRah OÜ regarding your use of the service, and supersede any prior agreements on this subject.
